1. Acceptance of terms
By accessing or using basischfit.com (the "Site"), our mobile and web applications (the "App"), or any of our coaching services (collectively, the "Services"), you agree to these Terms & Conditions (the "Terms") and to our Privacy Policy. If you do not agree, please do not use the Services.
These Terms form a legally binding contract between you and BasischFit Coaching GmbH ("BasischFit", "we", "our", "us"), a German company registered under HRB 123456 with its registered office at Hohenzollernring 42, 50672 Köln, Germany.
2. Eligibility
You must be at least 18 years old to create an account and use the Services. By using the Services you represent that you are 18 or older, that the information you provide is accurate, and that your use of the Services will not violate any applicable law.
We may suspend or terminate accounts that we believe were created by anyone under 18.
3. Health disclaimer
The Services provide general fitness, nutrition and lifestyle coaching. They do not constitute medical advice, diagnosis, treatment or therapy. Always consult your physician before beginning a new exercise program or making significant changes to your diet, particularly if you have any pre-existing condition, are pregnant, are recovering from injury or surgery, or are taking medication.
By using the Services you accept full responsibility for your own health and physical wellbeing. If you experience pain, dizziness or any other symptom during training, stop immediately and seek medical advice.
4. Your account
You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account. Notify us immediately at info@basischfit.com if you suspect unauthorized access.
You agree to provide accurate, current and complete information when registering, and to update that information when it changes.
We reserve the right to suspend or terminate accounts for any breach of these Terms, including failure to pay, abusive behavior toward coaches or staff, or attempts to compromise the security of the Services.
5. Acceptable use
You agree not to: (a) use the Services for any unlawful purpose; (b) reverse engineer, decompile or attempt to extract source code from the App; (c) resell, sublicense or commercially exploit any part of the Services without our prior written consent; (d) upload viruses, malicious code or anything that could damage our systems; (e) impersonate another person or misrepresent your affiliation with anyone; (f) harvest data about other users; (g) use the Services to harass, threaten or defame any other person.
6. Intellectual property
All content on the Site and App — including text, graphics, logos, training programs, nutrition templates, videos, articles, podcasts and software — is the property of BasischFit or its licensors and is protected by copyright, trademark and other intellectual property laws.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services for your own non-commercial use, subject to these Terms. All other rights are reserved.
You retain ownership of any content you submit (check-ins, photos, messages). By submitting it, you grant us a worldwide, royalty-free license to use, store and process it solely for the purpose of providing the Services to you.
7. Subscriptions and payment
Paid Services are billed in advance on a recurring monthly basis, in EUR or your local currency where available, beginning on the day you subscribe. Prices include applicable VAT.
You authorize us, through our payment processor (Stripe), to charge the payment method on file at the start of each billing cycle. If a payment fails, we'll retry up to three times before suspending access.
Subscriptions renew automatically. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing cycle, and you retain access until then.
Refunds: we offer a 14-day money-back guarantee on your first month. After that, we do not refund partial or completed billing cycles, but you can cancel future renewals at any time.
8. Free trials and promotional offers
From time to time we offer free trials or promotional pricing. Unless stated otherwise, you must cancel before the end of the trial to avoid being charged. Promotional pricing applies only to the period specified and reverts to the standard rate afterwards.
9. Limitation of liability
To the maximum extent permitted by law, BasischFit, its directors, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to loss of profits, data, goodwill or other intangible losses, arising out of or in connection with your use of the Services.
Our total aggregate liability to you for all claims arising from or related to the Services will not exceed the amount you paid us in the twelve months preceding the event giving rise to the claim, or €100, whichever is greater.
Nothing in these Terms limits our liability for gross negligence, intentional misconduct, death or personal injury caused by our negligence, or any other liability that cannot be excluded under applicable law.
10. Indemnification
You agree to indemnify and hold harmless BasischFit, its affiliates, officers and employees from any claim, loss, liability or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Services or your violation of any third party's rights.
11. Termination
You may stop using the Services and cancel your subscription at any time. We may suspend or terminate your access (a) for material breach of these Terms, (b) if required by law, (c) if continued provision becomes commercially or technically impractical, or (d) if your conduct presents a risk to other members or our staff. Where reasonable, we will give you notice and an opportunity to remedy the issue first.
Sections of these Terms that by their nature should survive termination (intellectual property, limitation of liability, governing law, etc.) will survive.
12. Changes to the Services and these Terms
We will continue to develop the Services and may add, change or remove features at any time. Where a change is material, we'll let you know in advance.
We may update these Terms from time to time. The updated version will be posted on this page with a new "last updated" date. If a change is material, we'll notify you by email at least 14 days before it takes effect. Your continued use of the Services after the effective date constitutes acceptance.
13. Governing law and jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-laws rules. The exclusive place of jurisdiction for all disputes is Cologne, Germany, except where mandatory consumer-protection law in your country of residence provides otherwise.
Nothing in this section limits your right as a consumer to bring proceedings in your country of habitual residence.
